EPS Failure - Getting BMW to reimburse

I just replaced the EPS on my 2011 E89 with 48,000 miles ($2k USD installed). There was a recall for this issue on 2012 and newer E89s but the build date on my '11 is about 8 months too soon to qualify, even though the fault codes are exactly the same as the recalled units. Has anyone attempted to get BMW to cover this even though it's outside the recall date range? Hard to believe BMW expects customer to pay for failure of such a foundational/critical component. Thanks
