As someone who has recently gone through a similar situation...
Make a deal amicably between yourselves. No lawyers.
Work yourself the best deal and bounce. Thats it. If you choose to go to war - you will lose. I can almost guarantee that. You have to fight your battles in other ways.
I ended up with a 50/50 split on home equity as well. You'll be fine if you play your cards right.
