Halloween Crash
Hey guys, I hate to have this as my first post, but I thought id share with you guys. Was driving home from work on halloween when a pizza delivery driver ran a stop sign in front of me. Had no time to react so I went into him. Luckily just a few scratches and a severe sprain, nothing serious. Police ticketed him for running stop sign.Just hope the car isn't totaled...
UPDATE: just found out the guy only has 10K worth of insurance....gonna have to make a claim against mine for the remainder... |

Was he delivering pizza at the time? If so, get the money from the pizza shop. They're liable. They might be liable in any event, depending on the circumstances.

If the guy was on the job, then corporate is liable. You should get a lawyer if they're not cooperative.

Sorry to see this to such a fine automobile ... hope you are okay that is the main thing.
Make sure the car is checked out good at a certified BMW Auto Body Shop. My car got hit in the back 2 weeks ago and that is one thing I've learned, that warranty may be pulled if the repair is not done at a certified shop. Good luck ! PS. Make sure your under frame is not bend or twisted and that all welds be non destructively inspected for cracks. Here in Canada Insurance Companies guarantee the repairs for as long as one owns the car. Also, our Insurance companies have certified repair shops they refer people to for the same reasons re: warranty. Still, he is at fault, you are disadvantaged in two ways 1) you have the problems to get your car fixed and or replaced and 2) it will now be on the record that your car was in an accident this in turn will in the end lower your car's value should you decide to sell it.

Actually, your estimate seems pretty reasonable based on the photos. Each headlight assembly is 2 or 3 thousand US min, if I remember correctly, not to mention the hood, fascia, supports, etc., plus paint. The damage overall looks superficial except for the area right in front of driver side tire. Even then I don't think it's that bad. May need a little frame straightening there but as you mention you won't know for sure until they take all the damaged parts off.
Get it fixed and sell it back to the dealer - he won't care.

Why not trade it in as is (with the insurance quote on it I mean) and let it be the dealer's problem? I know of a few people that've done that actually. They lose only a couple thousand on the trade but they get a new car right away as opposed to having it sit in the shop for several months.

The bottom of both front fenders does show any change with the kick panels, so I would suspect that the hood, front bumper and supports did their jobs and sacrificed themselves to save the more critical structural components. I have seen worse, this looks superficial, although it is extremely painful to look at.

Had a similar mishap with a SAAB a decade ago.
Of the total cost, $10K are probably caused by the airbag deployment: airbags themselves ($1K each), airbag electronic module, steering wheel, dashboard, possibly a new steering column. The frame is probably intact and the car shoud be driveable and sell at a decent price once repaired. Best bet is to trade it in for a new one. You don't even have to tell them what it's been through unless they ask first.
