The liability problem isn't because of the participant's danger. It's due to the fact that BMW CCA requires a PASSENGER as an instructor. Most of the other organizations that do not require any instructors to ride passenger probably don't care if you roll over and incur serious damage, because, frankly, if they're lawyer is worth a damn, you should have signed your life away when you entered the premises.

However, since BMW CCA REQUIRE that all their track events that an instructor be available to all participant whenever they're on track, it means when sh*t does hit the fan, they're fully and 100% liable for the damage to the instructor in the car, riding as a passenger. Imagine a roll over accident involving an instructor in the passenger seat, and if said instructor were to get HURT. There'll be no end to BMW CCA's troubles in sight, IMO.
